Terms of service

These terms govern the use of PassFunk (passfunk.com), provided by Luca Rocchi, Rome (Italy), contact support@passfunk.com. By signing up a shop you accept them.

The service

PassFunk lets shops and businesses create a digital card for Apple Wallet and Google Wallet, hand it out to their customers through a QR code and a link, publish offers and vouchers, and send notifications to the cards. The service is for businesses and professionals only, not for consumers.

Account

You sign in with a Google or Apple account. You are responsible for what happens under your account and for the accuracy of the data you enter. One account can manage several shops.

Free trial and subscription

• Every new shop gets a 30-day free trial with all features, no credit card required.
• After the trial you need the Pro subscription, which costs €120 per year + VAT. If you subscribe during the trial, the first charge happens when the trial ends.
• The subscription renews automatically at the end of each period unless you turn renewal off.
• The subscription is sold by Stripe as authorised reseller (merchant of record): Stripe takes the payment, applies the VAT of your country and issues receipts and invoices, available on the Subscription page of the dashboard.
• You can turn renewal off at any time from the dashboard: the subscription stays active until the end of the paid period and is then not renewed. Partially used periods are not refunded, unless the law says otherwise.
• We may change the price with at least 30 days' notice; the new price applies from the next renewal.

Without an active subscription

When the trial ends without a subscription, or a subscription expires without renewal, the cards already in customers' phones stay, but you can't publish new offers or hand out new cards until you subscribe. The dashboard stays available.

Your commitments

• Publish real offers and honour them for customers who show the card.
• Only use logos, images and texts you have the rights to.
• Follow the consumer protection, advertising and pricing rules that apply to your business.
• Don't use notifications for misleading, offensive or unrelated messages, and don't send them too often.

We may suspend a shop that breaks these rules or uses the service in a way that harms others, letting you know when possible.

Availability

We do our best to keep the service available, but we can't guarantee it will never be interrupted. PassFunk depends on Apple Wallet and Google Wallet: changes or outages decided by Apple or Google may affect the service.

Liability

To the extent permitted by law, our total liability is limited to the amount you paid for the service in the 12 months before the event, and we are not liable for indirect damages such as lost profits. This does not limit liability that cannot be limited by law, such as for wilful misconduct or gross negligence.

Your content

Your logo, images and texts remain yours. You allow us to use them only to run the service, that is to show them on the card and on your shop's page.

Closing your account

You can close your account by writing to support@passfunk.com: we delete the shop's data as described in the privacy policy.

Changes

We may update these terms. For important changes we notify you at least 30 days in advance; if you don't accept them you can cancel before they take effect.

Governing law

Italian law applies. The courts of Rome have jurisdiction over any dispute.
